Competitive Shooting Event Participant Agreement

NOTICE: BY COMPLETING REGISTRATION FOR ANY EVENT HOSTED, ORGANIZED, OR OPERATED BY ACTION MEDIA LLC (dba ACTION GUNNER), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THE TERMS OF THIS LIABILITY RELEASE, WAIVER, AND INDEMNITY AGREEMENT. THIS AGREEMENT CONSTITUTES A LEGALLY BINDING CONTRACT AND AFFECTS YOUR LEGAL RIGHTS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT REGISTER FOR OR PARTICIPATE IN THIS EVENT.

This Agreement is effective upon registration and applies to all Action Media LLC / Action Gunner events in which you participate during the calendar year of registration.

1. Definitions

"Action Gunner" / "Action Media LLC" means Action Media LLC, a Minnesota limited liability company operating under the trade name Action Gunner, together with its members, officers, employees, contractors, volunteers, staff, agents, and representatives.

"Event" means any competitive shooting match, tactical competition, training event, or related activity organized, hosted, or operated by Action Media LLC / Action Gunner, including but not limited to the Action Gunner Tactical 2-Gun Series and any associated activities.

"Host Facility" means the shooting range, club, or property at which an Event is held, together with its owners, officers, employees, and agents.

"Participant" / "I" / "You" means the individual completing registration, including any observer, spectator, or guest accompanying the registered participant.

"Releasees" means Action Media LLC, its members, managers, officers, employees, contractors, volunteers, sponsors, and the Host Facility collectively.

2. Express Assumption of Risk

I understand and acknowledge that participation in competitive shooting events involves inherent risks that cannot be eliminated, including but not limited to:

1. Accidental discharge of firearms by myself or other participants;
2. Injury from projectiles, ricochets, or fragmentation of ammunition or targets;
3. Injury from the handling, loading, or operation of firearms, ammunition, or related equipment;
4. Physical injury resulting from the use of physical obstacles, barriers, barricades, or course of fire elements, including falls or exertion-related injury;
5. Exposure to loud noise, dust, and other environmental conditions at a shooting range;
6. Injury caused by equipment failure, malfunction, or misuse;
7. Actions or negligence of other participants, spectators, staff, or volunteers;
8. Any other risk inherent to competitive shooting sports, physical activity, or use of a shooting range facility.

I freely and voluntarily accept and assume all such risks. I am participating by my own free will and have made an independent decision to do so, despite these risks and potential hazards.

3. Release of Liability and Waiver of Claims

In consideration for being permitted to participate in any Action Gunner Event, and for other good and valuable consideration, I hereby agree to the following:

1. Waiver and release of claims. I waive, release, and forever discharge the Releasees from any and all claims, demands, actions, causes of action, damages, losses, costs, and liabilities of any kind or nature, whether known or unknown, arising out of or relating to my participation in any Event. This includes claims arising from the active or passive negligence of the Releasees.
2. Scope of release. This release applies to all claims including but not limited to personal injury, bodily injury, disability, death, property damage, loss of income, emotional distress, and any other loss or damage, whether caused by the negligence of the Releasees or otherwise.
3. Estate and heirs. This release is binding upon and inures to the benefit of my estate, heirs, executors, administrators, and assigns.
4. Insurance. I understand that Action Media LLC carries commercial general liability insurance covering Events it operates. I further understand and agree that this insurance coverage does not create any obligation on the part of Action Media LLC to compensate me for any injury, loss, or damage, and this Agreement remains fully enforceable regardless of insurance coverage.

4. Indemnification

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, suits, demands, judgments, losses, costs, fines, penalties, and expenses (including reasonable attorneys' fees) arising from or related to:

1. My negligent or intentional acts or omissions at any Event;
2. My failure to comply with applicable safety rules, range procedures, or the terms of this Agreement;
3. Any injury, death, or property damage caused to any third party as a result of my conduct;
4. The acts or omissions of any guest or non-registered individual I bring to an Event.

5. Safety Rules and Range Procedures

I agree to comply with all safety rules and range procedures established by Action Media LLC, the Host Facility, and applicable match staff. I acknowledge that:

1. It is my responsibility to know and understand all applicable safety rules before participating;
2. Violations of safety rules may result in immediate disqualification from the stage, match, or ejection from the facility, at the sole discretion of match staff;
3. Unsafe firearm handling will not be tolerated under any circumstances and may result in a match disqualification (DQ) and removal from the premises;
4. I will follow all commands issued by Range Officers and match staff immediately and without argument.

6. Ammunition and Equipment Policy

BY REGISTERING FOR THIS EVENT, I CONFIRM THAT I HAVE READ THE APPLICABLE MATCH RULES REGARDING PERMITTED AMMUNITION AND EQUIPMENT, AND I AGREE THAT:

1. I will not use any ammunition prohibited under the match rules, including but not limited to steel-core, steel-jacketed, tracer, incendiary, armor-piercing, or any other restricted ammunition type;
2. If I am found to have used prohibited ammunition and such ammunition causes damage to range property, targets, or equipment, I will be financially liable for the full replacement cost of any damaged materials;
3. Use of prohibited ammunition will result in a stage or match disqualification and may result in a ban from future Action Gunner events until any financial obligation for damages is satisfied;
4. My firearms and equipment must be in safe operating condition. I am solely responsible for the safe operation of my equipment throughout the Event.

7. Media and Photography Release

I grant Action Media LLC / Action Gunner a non-exclusive, royalty-free, perpetual license to photograph, film, and record my participation in Events and to use my name, likeness, image, voice, and competition results in connection with Action Gunner's media, marketing, editorial content, social media, and promotional materials. I understand that Action Gunner is a competitive shooting media company and that match coverage is a core part of its operations.

If I do not wish to be photographed or filmed, I must notify match staff in writing prior to the start of the Event.

8. General Provisions

1. Governing law. This Agreement shall be governed by and interpreted under the laws of the State of Minnesota. Any dispute arising out of or related to this Agreement shall be brought exclusively in the state or federal courts located in Minnesota.
2. Severability. If any provision of this Agreement is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect.
3. Entire agreement. This Agreement constitutes the entire agreement between the parties with respect to its subject matter. I am not relying on any oral or written representations other than those set forth in this Agreement.
4. Voluntary execution. I affirm that I am 18 years of age or older, that I am legally competent to enter into this Agreement, that I have read it carefully, that I understand it fully, and that I voluntarily accept and agree to be bound by its terms.
5. Annual applicability. This Agreement is effective upon registration and applies to all Action Media LLC / Action Gunner events in which I participate during the calendar year in which I register. A new Agreement is required each calendar year.
